Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between MawuRapha Solutions Limited ("Kingdom Vitals", "we", "us", "our") and the church or organization signing up for the Kingdom Vitals platform ("you", "your", "the Church"). By creating an account or using Kingdom Vitals, you agree to these Terms and to our Privacy Policy.

1. Acceptance of Terms

By accessing our website, creating a Kingdom Vitals account, or using any part of the Service, you accept these Terms in full. If you're accepting on behalf of a church or organization, you confirm you have the authority to bind that organization to these Terms.

2. Definitions

  • "Kingdom Vitals" / "the Service" — the church management software platform provided by MawuRapha Solutions Limited.
  • "Church" / "Organization" / "you" — the church or organization that registers for Kingdom Vitals.
  • "Church Member" — a member, visitor, or congregant whose information a Church enters into the Service.
  • "Content" — any data, records, or files a Church or its users enter into or upload to the Service.

3. Eligibility

You must be at least 18 years old and have the authority to act on behalf of the Church or organization you're registering to use the Service.

4. The Service

Kingdom Vitals is a platform for managing church membership, attendance, giving and finances, events, volunteers, communications, welfare and benevolence support, and related AI-assisted insights. We may add, change, or remove features over time as the Service evolves.

5. Account Registration & Security

You agree to provide accurate registration information and keep it up to date. You're responsible for keeping your password and any two-factor authentication method secure, and for all activity that happens under your account. Tell us right away at support@kingdomvitals.app if you suspect unauthorized use of your account.

6. Your Responsibilities as a Church or Organization

As explained in our Privacy Policy, you are the Data Controller, under Ghana's Data Protection Act, 2012 (Act 843), for the personal data of your members and congregants that you enter into the Service. This means you are responsible for:

  • Having a lawful basis to collect and process that data — including obtaining a parent or guardian's consent before entering a child's information.
  • Only entering data you have the right to hold and share with us for the purposes of using the Service.
  • Responding to your members' data-protection requests (we'll support you in doing so).
  • Complying with Act 843 and any other laws that apply to your organization.

7. Subscription Plans, Free Trial & Payment

New Churches get a 14-day free trial with access to the Service. After your trial ends, continued use requires an active paid subscription. Subscriptions are billed through Paystack in Ghana Cedis (GHS) at the price shown for your chosen plan at the time of purchase, plus any applicable taxes. If you upgrade to a higher plan mid-cycle, we prorate the change and credit the unused portion of your current plan toward the new one.

8. Cancellations & Refunds

You may cancel your subscription at any time from your account settings. When you cancel, you keep access to the Service until the end of your current billing period — we do not provide refunds for the unused portion of a billing period.

9. Acceptable Use

You agree not to use Kingdom Vitals to:

  • Send unlawful, harassing, fraudulent, or unsolicited (spam) messages via SMS or email.
  • Upload or process personal data you don't have a lawful right to collect or share with us.
  • Attempt to breach the security of the Service, or access another Church's data without authorization.
  • Reverse-engineer, copy, or resell the Service without our written permission.
  • Use the Service in any way that violates Ghanaian law.

We may suspend or terminate accounts that violate this section.

10. Intellectual Property

Kingdom Vitals, its software, design, and branding remain the property of MawuRapha Solutions Limited. We grant you a limited, non-exclusive right to use the Service for your Church's own purposes while your subscription is active. You retain ownership of your Church's own Content — the data and records you enter into the platform.

11. Third-Party Services

The Service relies on third-party providers, including Paystack for payments, TextTango for SMS delivery, and several AI providers for AI-assisted features. We aren't liable for outages, errors, or failures of these third-party services that are outside our reasonable control.

12. Data Protection

Our Privacy Policy explains in full how personal data is collected, used, and protected, and describes the Data Controller / Data Processor relationship between you and Kingdom Vitals summarized in Section 6 above. It forms part of these Terms.

13. Service Availability & Disclaimers

We work to keep Kingdom Vitals available and reliable, but the Service is provided "as is" and "as available", without a guaranteed uptime unless separately agreed in writing. AI-generated insights, suggestions, and classifications are informational only — they are not financial, legal, medical, or pastoral advice, and should be reviewed by a person before being relied on.

14. Limitation of Liability

To the fullest extent permitted by the laws of Ghana, MawuRapha Solutions Limited will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service.

15. Indemnification

You agree to indemnify and hold MawuRapha Solutions Limited harmless from any claim arising from your unlawful use of the Service, or from data you upload that you did not have the right to collect or share with us.

16. Termination

You may stop using the Service and cancel your subscription at any time (Section 8). We may suspend or terminate your account for breach of these Terms, non-payment, or unlawful use of the Service, giving reasonable notice where practicable.

17. Force Majeure

We won't be liable for any delay or failure to perform caused by events beyond our reasonable control, including internet or power outages, natural disasters, or actions of third-party providers.

18. Changes to These Terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes we'll make reasonable efforts to notify Church administrators directly. Continuing to use the Service after changes take effect means you accept them.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Ghana. If a dispute arises, we encourage you to contact us first so we can try to resolve it informally. Any dispute that can't be resolved this way is subject to the exclusive jurisdiction of the courts of Ghana.
